Terms of Service

These Terms of Service ("Terms") govern your use of TellRide ("the Service"), provided by Bracino OÜ, registered in the Republic of Estonia under registry code 12452492 ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

TellRide is a web application that uses your device's GPS to identify points of interest near you and plays short narrated stories about them through your browser. Stories are generated by combining publicly available source material (primarily Wikipedia) with an AI rewrite step. The Service is delivered over the public internet to a modern web browser; we do not currently distribute a native iOS or Android app.

You must be at least 16 years old (or the equivalent minimum age in your jurisdiction) to create an account. You confirm, by creating an account, that you meet this requirement. The Service is intended for personal, non-commercial use.

4. Accounts

You can use the Service by creating an account with an email and password, or by signing in with Google. You are responsible for keeping your credentials safe. If you suspect unauthorised use of your account, change your password and email info@tellride.xyz.

You may delete your account at any time by emailing info@tellride.xyz. We will remove your account data within 30 days, subject to Section 7.

Safety: TellRide is designed to be heard, not watched. Treat it like a podcast. Set up the app while parked. We disclaim all responsibility for any consequence of using the Service while driving in violation of road traffic law or basic prudence.

6. Free tier and future paid tiers

6.1 Current state

The Service is currently free for all users. There is no usage cap during beta. We may introduce reasonable rate limits to prevent abuse.

We plan to launch a paid Pro tier with additional features (custom stories, premium voice). When Pro launches:

When Pro launches, refunds will be governed by the Refund Policy. In short: a 14-day no-questions-asked refund window on the first Pro purchase, and a prorated approach for downgrades during a paid period.

7. Your content

If you create custom stories or supply text content to the Service, you retain ownership. You grant us a non-exclusive, worldwide, royalty-free licence to host, process, and serve that content back to you and (when applicable) to other users to whom you have chosen to make it visible. We do not sell or sublicense your content.

8. Our content; AI-generated stories

Stories are generated from publicly available source material (principally Wikipedia, which is licensed under Creative Commons BY-SA 4.0). The original Wikipedia text remains under its original licence; the AI-rewritten narration produced by TellRide is provided to you for personal listening. You may not republish or commercially exploit the narration output without our written permission.

We do our best to keep stories accurate and respectful, but AI-generated text can contain errors, omissions, or outdated information. Do not rely on TellRide for navigation, emergency, or any life-safety decisions.

9. Intellectual property

The TellRide name, logo, software, and the structure, selection, and arrangement of the Service are our intellectual property. These Terms grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for personal purposes. Nothing in these Terms transfers any of our intellectual property to you.

10. Disclaimers

The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of liability

To the maximum extent permitted by applicable law, our aggregate liability to you in connection with the Service in any 12-month period is limited to the greater of (a) the amount you have paid to us in that period, or (b) €50. We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or substitute service procurement.

Nothing in these Terms limits liability that cannot lawfully be limited under Estonian law or the law of your country of residence as an EU/EEA consumer.

12. Termination

You can terminate your use of the Service at any time by deleting your account. We can suspend or terminate your access if you materially breach these Terms, with notice where reasonably practicable. Sections that by their nature should survive (Sections 7, 8, 9, 10, 11, 13) survive termination.

13. Governing law and dispute resolution

These Terms are governed by the law of the Republic of Estonia, without regard to its conflict-of-law principles. The courts of Harju County, Estonia, have exclusive jurisdiction over any dispute, subject to the mandatory consumer protections of your country of residence if you are an EU/EEA consumer.

EU consumers may also use the European Commission's online dispute resolution platform at ec.europa.eu/consumers/odr, although we prefer to resolve issues directly first. Estonian consumers may also turn to the Consumer Disputes Committee operated by the Consumer Protection and Technical Regulatory Authority (komisjon.ee).

14. Changes to these Terms

We may revise these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. If we make material changes, we will notify registered users by email at least 14 days before the change takes effect. Continued use after the effective date constitutes acceptance.
